An Act to Establish a Natural Science Research Center in the University of the Philippines, to Provide for its Administration and Support, and for Other Purposes

Be it enacted by the Senate and House of Representatives of the Philippine Congress Assembled:

Section 1

Pursuant to the national policy of promoting scientific research and invention in the Philippines, there is hereby established in the University of the Philippines a Natural Science Research Center, hereinafter referred to as the Center.

Section 2

The Center shall consist of:

(a)suitable physical facilities for study and laboratory research of graduate and post graduate level in the basic natural sciences and mathematics;

(b)accessory physical facilities for related activities as lectures, dissemination of information, communication, analytical and consultative service, instrumentation, and collaboration with other scientific organizations;

(c)a regular staff of research scientists, technicians and administrative personnel, to be augmented as circumstances require, by guest researchers, special lecturers, and visiting technicians.

Section 3

The Center shall discharge the following functions:

(a)To undertake fundamental studies and laboratory research in the natural sciences and mathematics, and to disseminate the findings of such studies;

(b)To collaborate with the graduate schools of the University of the Philippines in creating a scientific climate and research tradition in the University in particular, and in the country in general;

(c)To provide assistance, on request and when feasible, to other research agencies, government and private.

(d)To collaborate, on request and when feasible with other schools, organizations or individuals in the furtherance of scientific knowledge and research.

Section 4

The Center shall be administered by an Advisory Executive Council, herein referred to as the Council which shall be composed of such members as there are Departments in the Division of Natural Sciences in the College of Arts and Sciences, University of the Philippines, having a graduate program, each member to be elected by the respective Department, and two other members who shall be appointed by the Board of Regents upon recommendation of the President of the University: Provided, However, That membership in the Council shall be limited to faculty members of the Divisions who, at the time of their election or appointment, are permanent, active in teaching and research, and not in any University administration position. The elective members shall have a tenure of two calendar years and the appointive members, one calendar year. Membership in the Council shall entitle a faculty member to such reduction in teaching load as his work in the Center requires and at the discretion of the Board of Regents, the Council may be paid honoraria.

Section 5

Subject to the control and supervision of the University, the Council shall exercise the following powers:

(a)To prescribe rules and regulations for the government of the Council and for the operation of the Center as it shall deem necessary and reasonable;

(b)To maintain, as adequately as possible, a scientific library and appropriate laboratories for instruction and research in the Sciences, which shall be available to the public under such rules and regulations as it may deem proper;

(c)To promote cooperation in the research activities of the University and of other educational institutions;

(d)To establish a system of priorities for research projects, particularly in the fields of physics, chemistry, biology, geology, and mathematics;

(e)To review and analyze scientific and technological projects, schedules of activities, programs and projects, schedules of activities, programs and project proposals including the progress of projects being undertaken, and to take such measures as may be necessary to accomplish the objectives and policies involved in these activities;

(f)To disseminate the results of scientific and technological research and to encourage their practical application.

Section 6

The Board of Regents of the University of the Philippines, shall on the recommendation of the President, act in behalf of the Council and the Center, as in the case of other units of the University.

Section 7

Any provision of law to the contrary notwithstanding, any patentable invention, discovery, device or process, or any other form of intellectual property, shall belong jointly to the University of the Philippines and to the scientist, scholar or researcher (or to the scientists, scholars, or researchers in case of joint projects) responsible for the same, whenever such invention, discovery, device, process or any other form of intellectual property is developed, created, invented or devised with the facilities or assistance in any form whatever, in whole or in part, extended by the Center in accordance with the existing rules and regulations of the Council. Such joint ownership shall only entitle the scientist, scholar or researcher concerned to receive royalties in such percentage and under such conditions as the Council may prescribe through appropriate rules and regulations: Provided, However, That such royalties shall not be less than twenty percent nor more than fifty per cent of the total net proceeds from such invention, discovery, device, process or other intellectual property: And Provided, further, That the entire share of the University of the Philippines therefrom, shall be applied exclusively for the purpose of the Center in accordance with this Act.

Section 8

To provide the facilities and financial support for the Center the sum of two million pesos is hereby authorized to be appropriated from the funds of the National Treasury not otherwise appropriated, for the capital and operating requirements of the Center for the current fiscal year.

Section 9

This Act shall take effect upon its approval.
