Editor’s notes from DOLE (1)

Sec. 57 of R.A. No. 7875, An Act Instituting a National Health Insurance Program for All Filipinos and Establishing the Philippine Health Insurance Corporation or the National Health Insurance Act of 1995, repealed E.O. No. 119 (1987), Reorganizing the Ministry of Health; P.D. No. 1519 (1969), Revised Philippine Medicare Act; and other laws applying to the Medicare. R.A. No. 7875 (1995) initiated the National Health Insurance Program intending to provide health insurance coverage and health care services for all Filipinos. To carry out the program, the law also created the Philippine Health Insurance Corporation, which has taken over the assets and functions of the Philippine Medical Care Commission. Under R.A. No. 7875 (1995), an employee is defined as “any person who performs services for an employer in which either or both mental and physical efforts are used and who receives compensation for such services, where there is an employer-employee relationship” while an employer is defined as “a natural or juridical person who employs the services of an employee.”
